Please read these Terms of Use (the “Terms”) carefully before accessing or using the Website, including any articles, insights, logos, publications, videos, images and other content or information made available on or through it (collectively, the “Content”). By accessing or using the Website or the Content, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree, you may not access or use the Website and the Content, and your only remedy is to stop using it.

The Website is owned and operated by LUMIKAI INTERACTIVE II LLP for itself, its affiliates and other related entities operating under the Lumikai name, including entities that sponsor, operate, manage or advise onshore and offshore investment funds and investment vehicles, as well as such funds and investment vehicles themselves (collectively, “Lumikai”, “we”, “us” or “our”).

These Terms form an agreement between you (the visitor or user, "you") and Lumikai and govern your access to and use of the Website and the Content.

1. Changes to these Terms

We may revise these Terms at any time by updating this page. Your continued use of the Website after any change means you accept the revised Terms. We recommend you review this page periodically. The date of the latest revision appears above.

2. No Offer, Solicitation, Advice or Reliance

The Website and the Content are provided for general information only. Accessing or using the Website, submitting information through it or otherwise communicating with Lumikai through the Website does not create any investment advisory, fiduciary, agency, client or other professional relationship with any Lumikai entity.

Any references to portfolio companies, investments, or performance are illustrative and non-exhaustive. They do not represent all investments made by any Lumikai funds, are not selected on the basis of performance, and should not be viewed as representative of the experience of any Lumikai fund as a whole. Past performance is not indicative of future results, and there is no assurance that comparable results will be achieved in the future. Any projections, estimates, targets, opinions or forward-looking statements may change without notice and may not prove to be correct. Dated content speaks only as of its stated date.

3. Third-Party Views and Content

Quotes, testimonials, or commentary from founders, portfolio companies, or other third parties appearing on the Website or in the Content, our YouTube channel, or the Alpha Women podcast reflect the personal views and experience of the individuals concerned, as of the date given. Such views are solely those of the relevant individuals and do not represent, and should not be attributed to Lumikai. The inclusion or publication of any such statement does not constitute its adoption, endorsement, verification or approval by Lumikai, and Lumikai makes no representation or warranty as to its accuracy or completeness. 

4. Intellectual property and ownership

The Content is owned by Lumikai or where it comprises third-party material, by the applicable third party, and is protected by applicable intellectual property laws. You may view and use the Content only for your personal, non-commercial review, subject to these Terms and any additional terms, notices or usage restrictions applicable to a particular item of Content. You must comply with any such additional restrictions. "Lumikai", the Lumikai logo, Alpha Women and other names, logos and marks on the Website created and used by Lumikai are owned by Lumikai and protected under applicable intellectual property laws. Other names and marks of third parties appearing on the Website remain the property of their respective owners and are displayed only in content concerning or featuring them. Their inclusion on the Website does not transfer or grant any rights in them to any user.

Nothing on the Website grants you any right or licence, whether express, implied or otherwise, to use any of these marks without the prior written consent of the applicable owner. You may not copy, imitate, alter or use, or apply to register, any such mark or any confusingly similar name, logo, domain name or social-media identifier. 7. Unsolicited submissions and feedback

Unless we have signed a written non-disclosure agreement with you covering the material, any information you send us through the Website, including unsolicited business plans, pitch decks, ideas, or feedback, will be treated as non-confidential and non-proprietary. You agree not to send us material you consider confidential without such an agreement in place, and we may use any such feedback for any purpose without obligation to you.

Third parties may impersonate Lumikai or falsely claim an association with Lumikai, any Lumikai entity or fund, our brands, portfolio companies or team members, including by creating cloned, copied or spoofed versions of the Website, lookalike or misspelled domain names, or unauthorised websites, email addresses, social-media accounts or messaging profiles. Lumikai does not publicly solicit investments through the Website or social media, guarantee investment returns, or request fund transfers to personal accounts, digital wallets, unverified third-party accounts or any account that has not been identified in formal fund or transaction documentation or independently verified through authorised Lumikai channels; any genuine investment or co-investment opportunity, if and when lawfully offered, will be communicated through verifiable channels and governed by formal offering or transaction documents. You should independently verify any person, communication or opportunity claiming an association with Lumikai before providing personal information, transferring funds or taking any other action, and Lumikai will not, to the fullest extent permitted by law, be responsible for losses arising from the acts of unauthorised third parties.

These Terms, together with the Privacy Policy, are the entire agreement between you and Lumikai regarding the Website and the Content. If any provision is held invalid or unenforceable, the remaining provisions continue in effect. Our failure to enforce any provision is not a waiver of it.
